# Terms of Service for Looxer.ai *Effective Date:* March 19, 2026 We are LooxerAI LLC ("Company," "we," "our," "us"), a company registered in Delaware, United States at 1111B S Governors Ave STE 26475, Dover, DE 19904, US. We operate the mobile application Looxer.ai (the "App"), as well as any other related products and services that refer or link to these terms (the "Services"). These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and LooxerAI LLC, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Services and you must discontinue use immediately. --- ## 1. *Eligibility* You must be at least 13 years old to use Looxer.ai. By using our services, you represent and warrant that you meet this eligibility requirement and have the legal capacity to agree to these Terms. --- ## 2. *Description of the Service* Looxer.ai provides AI-powered facial analysis, full-potential morph visualizations, transformation videos, habit tracking, and AI-powered meal estimation. The App uses Google and Apple authentication for secure login. --- ## 3. *Purchases and Subscriptions* We offer auto-renewable subscription plans that provide access to premium features. By subscribing, you authorize recurring charges to your chosen payment method. Subscriptions automatically renew unless cancelled before the end of the current billing period. ### *Available Plans* - Monthly Plan: $7/month, billed monthly. - Yearly Plan: $59/year, billed annually. Prices are subject to change. Cancellation takes effect at the end of the current billing period. Payment is processed through the Apple App Store, Google Play Store, or Stripe. --- ## 4. *Data Collection and Use* ### *Data We Collect* - *OAuth Authentication Token:* Used for secure access via Google or Apple authentication. - *Uploaded Photos:* Selfies and images provided by you for AI-powered facial analysis, morph generation, and video creation. - *Meal Photos:* Images of food for AI-powered calorie and macro estimation. ### *How We Use Your Data* - To perform AI-powered facial analysis and generate full-potential morph visualizations using third-party AI services. - To create transformation videos using third-party AI services. - To provide AI-powered meal calorie and macro estimation via OpenAI. - To authenticate your account securely. We do not sell your data to third parties for marketing or advertising purposes. Certain data is shared with third-party AI service providers solely for the purpose of delivering our features, as described in our Privacy Policy. --- ## 5. *Your Responsibilities* - You agree to upload only images of yourself. Uploading images of others without their consent is prohibited. - You must not use the App for any unlawful or unauthorized purposes. - You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement, app store terms). --- ## 6. *Intellectual Property* All content and services provided by Looxer.ai, including but not limited to software, design, and images (excluding user-uploaded content), are the property of LooxerAI LLC and are protected by intellectual property laws. By using our App, you grant LooxerAI LLC a non-exclusive, royalty-free, and worldwide license to process your uploaded selfies solely for the purpose of providing our services. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, LooxerAI LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. --- ## 7. *Account Security* You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access or security breaches. --- ## 8. *Prohibited Activities* You agree not to: - Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App. - Copy, modify, or create derivative works of the App. - Upload harmful, offensive, or inappropriate content. - Attempt to breach the App's security measures. - Use the App for any revenue-generating endeavor or commercial enterprise other than its intended purpose. - Make the App available over a network permitting access by multiple devices or users at the same time. --- ## 9. *Disclaimer of Warranties* Looxer.ai is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will meet your expectations or that it will operate without interruptions or errors. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be LooxerAI LLC's sole responsibility. --- ## 10. *Limitation of Liability* To the fullest extent permitted by law, LooxerAI LLC and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability to you for any cause whatsoever shall at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising. --- ## 11. *Product Claims* You and LooxerAI LLC acknowledge that LooxerAI LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. --- ## 12. *Legal Compliance* You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. --- ## 13. *Mobile Application License* We grant you a revocable, non-exclusive, non-transferable, limited license to install and use the App on Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. --- ## 14. *Maintenance and Support* LooxerAI LLC is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. --- ## 15. *Termination* We reserve the right to suspend or terminate your access to the App at our discretion, with or without notice, for violating these Terms or for any other reason. --- ## 16. *Third-Party Beneficiary* You and LooxerAI LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof. --- ## 17. *Changes to the Terms* We may update these Terms from time to time. We will alert you about any changes by updating the "Effective Date" at the top of these Terms.
